Please be advised that in the process of performing contracts, we process your personal data. Details can be found below.

I. The administrator of the personal data

II. Data Protection Officer

The administrator is not obliged to appoint a Data Protection Officer.

III. Purpose and legal grounds of data processing

  1. to take steps at your request before entering into a contract (Article 6(1)(b) GDPR);
  2. to perform a contract with you (Article 6(1)(b) GDPR);
  3. for record-keeping and evidential purposes, based on our legitimate interest in retaining information that may be needed to establish facts (Article 6(1)(f) GDPR);
  4. to establish, exercise or defend legal claims, based on our legitimate interest in doing so (Article 6(1)(f) GDPR);
  5. for direct marketing based on our legitimate interest (Article 6(1)(f) and Recital 47 GDPR);
  6. for marketing based on your consent (Article 6(1)(a) GDPR). You may withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing based on consent before it was withdrawn.

IV. The categories of your data that we process:

We will process the following categories of your data

  1. Basic identification data (e.g. name, surname),
  2. Identification data granted by public authorities (e.g. Polish PESEL),
  3. Electronic identification data (telephone number),
  4. Complaints, incidents and accidents,

V. Recipients of data

We may disclose your personal data to entities that support us in performing the contract, including processors such as accounting, legal and IT service providers, loss adjusters and claims-handling service providers.

VI. Data transfer to third countries or international organisations

We do not transfer your data outside the European Union and the European Economic Area.

VII. Data storage period

Personal data relating to the contract will be retained for the applicable limitation period for claims arising from the contract and for one additional year to account for claims made at the end of that period and any delays in service of process.

If the contract is not concluded, your personal data related to discussions about this contract will be immediately deleted, except for the data needed for direct marketing.

We may process the personal data for the purposes of direct marketing of our products and services until you object to their processing for this purpose or we determine that they have become obsolete.

VIII. Your rights:

You have the right to:

  1. access to your data and receive a copy of it;
  2. rectify (correct) your data;
  3. the right to delete data (if we are not obliged to further process them under the law).

If you believe there is no legal basis for our processing of your personal data, you may request its erasure.

You may also request that we restrict the processing of your personal data to storage or to activities agreed with you.

You also have the right to object to the processing of data on the basis of a legitimate interest, as well as when the processing is necessary for us to perform a task carried out in the public interest.

In such a situation, you may inform us of any particular circumstances that justify our ceasing the processing to which you have objected. We will cease processing your data for these purposes unless we demonstrate compelling legitimate grounds for the processing that override your rights, or unless the processing is necessary for the establishment, exercise or defence of legal claims.

You have the right to receive the personal data you provided to us on the basis of a contract or your consent in a structured, commonly used and machine-readable format. You may also ask us to transmit those data directly to another controller where technically feasible.

Your personal data comes from publicly available sources, i.e. websites.

If you believe that we are processing your data unlawfully, you can submit a justified complaint to the Personal Data Protection Office or another competent supervisory authority.

You may withdraw your consent to the processing of personal data at any time. Withdrawal does not affect the lawfulness of processing based on consent before it was withdrawn.

IX. Information on the requirement / voluntary to provide data

Providing data is voluntary, but it is necessary to conclude a contract.
